Types of Criminal Cases
Criminal cases are filed by the County Attorney. There are three types of criminal cases: felonies, misdemeanors, and traffic or municipal ordinance violations.
Felony Criminal Cases
Preliminary hearings are used in felony cases to determine whether there is enough evidence to establish probable cause to believe that the person charged with committing the crime is responsible. If it appears the crime charged has been committed, and probable cause is established, the defendant will be bound over to appear in District Court.
Misdemeanor Criminal Cases
District Courts have concurrent jurisdiction in misdemeanor cases, but nearly all misdemeanor cases are tried in the County Courts.
